In these Terms, “Highly Unmotivated”, “we”, “us” and “our” refer to the seller identified above.
2. SCOPE OF THESE TERMS
These Terms govern the use of our website and the purchase of products through our online store.
By placing an order, you confirm that you have read and accepted these Terms, our Return Policy and our Privacy Policy.
Nothing in these Terms limits any mandatory rights granted to consumers under applicable law.
3. CUSTOMER REQUIREMENTS
To place an order, you must have the legal capacity to enter into a contract.
If you are under the age required to enter into a contract independently under the law applicable to you, an order may only be placed with the consent of your parent or legal guardian.
You are responsible for providing accurate and complete information when placing an order.
4. PRODUCTS
We sell clothing, accessories and other products presented on our website.
We make reasonable efforts to display product descriptions, colours, measurements and images accurately. However, colours may appear slightly different depending on the screen or device used.
Customers should review the product description and size guide before placing an order.
Minor differences in colour or appearance that result solely from screen settings do not constitute a product defect. This does not limit your statutory rights if a product is not compliant with the contract.
5. PRICES
Product prices are displayed in the currency shown on the website.
Prices shown to consumers include applicable taxes where required by law.
Delivery charges and any other applicable costs are displayed before the order is submitted.
If delivery outside the European Union is available, customs duties, import taxes or local charges may apply. Unless otherwise stated at checkout, these charges are imposed by local authorities and are the responsibility of the customer.
We may change product prices at any time. A price change will not affect an order for which a sales contract has already been concluded.
6. PLACING AN ORDER
To place an order, you must:
- select the products and available options,
- add the products to your shopping cart,
- provide the required contact and delivery information,
- select an available delivery and payment method,
- review the order and its total price,
- submit the order using the checkout button indicating an obligation to pay.
Submitting an order constitutes an offer to purchase the selected products.
A sales contract is concluded when we send you an order confirmation accepting your order.
An automated message confirming that we have received your order does not constitute acceptance unless the message clearly states that the order has been accepted.
7. ORDER ACCEPTANCE AND CANCELLATION
Before accepting an order, we may reject it where:
- a product is unavailable,
- payment cannot be authorised,
- the delivery address is outside the available delivery area,
- the information provided by the customer is incomplete or incorrect,
- we reasonably suspect fraud, misuse or unauthorised payment,
- an obvious technical or pricing error has occurred.
If payment has already been collected for an order that we cannot accept, the amount paid will be refunded using the original payment method.
After a sales contract has been concluded, we may cancel the order only where permitted by applicable law.
8. PAYMENT
Available payment methods are displayed during checkout.
Payments may be processed by independent payment service providers. Their additional terms and privacy policies may apply to the processing of the payment.
You confirm that you are authorised to use the selected payment method.
An order may not be processed until the payment has been successfully completed or authorised.
9. DELIVERY
Available delivery methods, costs and estimated delivery times are displayed during checkout.
Estimated delivery dates are provided for information and may be affected by circumstances outside our reasonable control.
We will deliver the order within the period communicated during checkout and, unless another delivery period has been agreed, no later than 30 days after the sales contract is concluded.
You are responsible for providing a complete and correct delivery address.
For consumers, the risk of accidental loss or damage passes to the customer when the customer or a person designated by the customer physically receives the products.

10. RIGHT OF WITHDRAWAL AND RETURNS
Consumers purchasing products online generally have the right to withdraw from the sales contract within 14 days of receiving the products, without giving a reason.
To exercise this right, contact us at info@highlyunmotivated.com before the withdrawal period expires.
Products must be returned within 14 days from the date on which you informed us of your decision to withdraw.
Unless the product is defective, damaged or incorrect, the customer is responsible for the direct cost of returning it.
We will refund eligible payments, including the cost of the least expensive standard delivery method offered for the order.
We may withhold the refund until we receive the returned products or until you provide evidence that they have been sent back, whichever occurs first.

11. PRODUCT CONFORMITY AND COMPLAINTS
We are legally responsible for ensuring that products supplied to consumers conform to the sales contract.
Our statutory responsibility for a lack of conformity lasts for two years from the date on which the product is delivered, unless applicable law provides the consumer with greater protection.

Your complaint should contain information allowing us to identify the purchase and understand the problem, such as:
- your name,
- your order number or another proof of purchase,
- a description of the issue,
- your requested solution.
Photographs may help us assess the complaint, but providing photographs is not a condition for submitting a complaint.
Depending on the circumstances and applicable law, you may request repair or replacement of the product.
Where the statutory conditions are met, you may also request a price reduction or withdraw from the sales contract.
We will respond to a consumer complaint within 14 days of receiving it.
The necessary costs of repairing, replacing or returning a product that does not conform to the contract will be borne by us in accordance with applicable law.
12. PROMOTIONS AND DISCOUNT CODES
Promotions and discount codes may be subject to additional conditions communicated with the relevant offer.
Unless otherwise stated:
- discount codes cannot be exchanged for cash,
- only one discount code may be used per order,
- discount codes cannot be applied after an order has been placed,
- discount codes may have an expiry date,
- discounts do not include delivery charges.
Promotional conditions do not limit mandatory consumer rights.
13. INTELLECTUAL PROPERTY
All content available on the website, including the Highly Unmotivated name, logos, graphics, illustrations, product designs, photographs, text and website layout, is owned by us or used under an appropriate licence.
You may use the website and its content only for personal and non-commercial purposes.
You may not copy, reproduce, modify, distribute, sell or commercially exploit our content without prior written permission.
Purchasing a product does not transfer any intellectual property rights relating to the product design, artwork or brand.
14. PROHIBITED USE

- for unlawful or fraudulent purposes,

15. WEBSITE AVAILABILITY

Such interruptions do not affect rights arising from sales contracts already concluded.

- supplying products that do not conform to the contract.
We are not responsible for delays or failures caused by events outside our reasonable control, provided that we take reasonable steps to limit their effects.

19. CHANGES TO THESE TERMS

The Terms applicable to an order are the version accepted by the customer when the order is placed.
Changes to these Terms will not retrospectively affect sales contracts already concluded.
20. GOVERNING LAW
These Terms and sales contracts concluded through the website are governed by Polish law.
If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protections granted by the law of your country of habitual residence.
Any disputes will be resolved by the courts having jurisdiction under applicable law.
21. OUT-OF-COURT DISPUTE RESOLUTION
Consumers may have access to out-of-court complaint and dispute resolution procedures provided by competent consumer protection or alternative dispute resolution bodies.
Using an out-of-court procedure is voluntary unless participation is required by applicable law.
